These terms of use are entered into by and between You and EJT CONSULTING LLC d/b/a 7-Figure Educator (“we,” or “us”). The following terms and conditions govern your access to and use of any content, functionality, or services offered on or through this website, located at ericajordanthomas.com and 7figureeducator.com and any related sites, applications, or forums (collectively, the “Website”), whether as a guest or a registered user.

By using the Website, purchasing something from us, or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use, Refund Policy and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these terms, you must not access or use the Website.

Our store is hosted by Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Sharing login information and passwords will result in immediate termination of our relationship and revocation of access to any of our content or materials, with no refund due. 

Availability and Modification of Products, Services and Prices

Prices for our products and services are subject to change without notice. We reserve the right at any time to modify or discontinue any product or service (or any part or content thereof) without notice at any time.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. 

We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors will be corrected.

No Returns or Refunds Policy

All Sales Final.  All purchases are final. No returns, exchanges, or cancellations are permitted under any circumstances once the transaction is completed, except as required by applicable law.

No Refunds. Refunds will not be issued for any reason, including but not limited to dissatisfaction with the product, ordering errors, or change of mind, unless otherwise mandated by law.

Damaged or Defective Goods. If an item arrives damaged or defective, you must notify us in writing within five days of receiving the item. Failure to notify us within this timeframe will result in forfeiture of any claim for replacement or remedy.

Proof of damage or defect, such as photographs, may be required.

Return of any damaged or defective product, in the condition in which it was received, must be complete within thirty days of receipt.

At our sole discretion, we may offer a replacement, store credit, or other remedy as permitted by law.

Non-Cancellable Orders.  Once an order is submitted, it is considered final and cannot be canceled or modified.

Compliance with Applicable Laws.  This policy complies with applicable consumer protection laws and regulations. Nothing in this policy is intended to limit or exclude any rights provided to consumers under such laws, including legally required refund rights for defective, undelivered, or misrepresented goods.

Arbitration

By using this Website or engaging in any services provided through this Website, you agree that any dispute, claim, or controversy arising out of or relating to your use of this Website, any products or services provided, or any related transaction (collectively, “Disputes”), will be resolved through binding arbitration administered by JAMS. The arbitration will take place in Raleigh, NC, and will be conducted before a single arbitrator.

The arbitration will be conducted by JAMS under its applicable rules, which are available on the JAMS website.

The parties agree to participate in the arbitration in good faith.

The arbitrator’s award shall be final and binding, and judgment on the award may be entered in any court having jurisdiction thereof.

By continuing to use this website, you acknowledge that you have read, understood, and agreed to this arbitration provision.

International Users. This arbitration provision applies to the maximum extent permitted by local law. If the law of your jurisdiction does not permit mandatory arbitration with a business, this section does not apply to you.

Waiver of Class Action

You agree to bring any claims to resolve Disputes solely in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

Exceptions

This arbitration agreement does not preclude either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent the violation of intellectual property rights or to preserve the status quo pending arbitration.

Waiver, Severability and Survival

No waiver by EJT CONSULTING LLC of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of EJT CONSULTING LLC to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

Entire Agreement

The Terms of Use and Privacy Policy constitute the sole and entire agreement between you and EJT CONSULTING LLC regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
